TERMS OF USE AND SERVICE

These Terms of Use and Service ("Agreement") govern your use of the e-commerce website www.rustiquestore.com (hereinafter referred to as the “Site”), operated by RUSTIQUE, located at Atatürk Mah. Yüce Sk. Triadpark B2 Building (1/C) No: 4, 34785 Sancaktepe/Istanbul, Türkiye.
By accessing or using the Site, you ("User") agree to be bound by this Agreement. If you do not agree to these terms, do not use the Site.
1. PARTIES
a) RUSTIQUE, the sole owner and operator of rustiquestore.com, hereinafter referred to as "RUSTIQUE" or "the Company".
b) User, an individual or entity who creates an account, makes a purchase, or otherwise accesses and/or uses the Site.
2. PURPOSE
This Agreement sets forth the terms and conditions under which the User may use the Site, purchase products, and interact with the content and services provided by RUSTIQUE.
3. USER RESPONSIBILITIES
3.1. The User affirms that all personal and contact information provided is accurate and current. RUSTIQUE shall not be held liable for any issues arising from false or outdated information and reserves the right to seek compensation for any resulting damages.
3.2. The User is solely responsible for the confidentiality of their account credentials and shall not share login information with any third party. RUSTIQUE reserves the right to pursue legal action for unauthorized access or misuse.
3.3. Users agree to comply with all applicable local and international laws and regulations when using the Site. Any unlawful activity is strictly prohibited and will result in immediate termination of access.
3.4. The Site may not be used to post or distribute content that is defamatory, harassing, obscene, infringing on intellectual property, or otherwise harmful to third parties or public order. Uploading viruses, malware, or engaging in spam or phishing is strictly prohibited.
3.5. The opinions, comments, or content shared by Users on the Site are their own and do not represent RUSTIQUE. RUSTIQUE bears no responsibility for any disputes, losses, or liabilities arising from such content.
3.6. RUSTIQUE makes reasonable efforts to ensure data security but cannot be held liable for any unauthorized access, data breaches, or damages to User data resulting from Site usage. Users access the Site at their own risk.
3.7. Users are prohibited from attempting to access or manipulate other users’ data or the Site’s systems. Violations may result in legal action and termination of access.
3.8. Breach of any clause of this Agreement may result in suspension or permanent termination of the User’s account without prior notice, and RUSTIQUE reserves the right to claim compensation for any resulting damages.
3.9. RUSTIQUE retains the right to modify, suspend, or delete any User account, data, or service at its sole discretion without liability. By using the Site, Users accept this authority.
3.10. All content, including design, software, text, graphics, logos, and trademarks on rustiquestore.com are the intellectual property of RUSTIQUE or its licensors and are protected by applicable copyright and trademark laws. Unauthorized use is strictly prohibited.
3.11. RUSTIQUE may collect limited data such as IP address, browser type, and access times to improve user experience and enhance Site functionality, in accordance with applicable privacy laws.
3.12. Personal data may be disclosed to third parties only when required by law or in good faith to protect the rights and property of RUSTIQUE or in compliance with legal obligations.
3.13. While RUSTIQUE implements industry-standard measures to keep the Site virus-free, it is the User's responsibility to ensure that their own systems are protected. RUSTIQUE disclaims liability for any resulting system damage or data loss.
3.14. RUSTIQUE reserves the right to alter, modify, or remove any part of the Site, including services and content, at any time, without prior notice.
3.15. This Agreement may be updated or amended by RUSTIQUE at its discretion. Continued use of the Site following any changes signifies acceptance of the revised terms. Updated terms become effective immediately upon publication.
3.16. The User agrees that all electronic records and logs held by RUSTIQUE are valid, binding, and constitute conclusive proof in the event of any dispute.
3.17. By agreeing to this Agreement, the User consents to receiving service-related communications, promotions, or updates via email or SMS, as provided during registration or checkout.
4. TERMINATION
This Agreement remains in effect until terminated by either party. Users may cancel their account at any time. RUSTIQUE may suspend or terminate User accounts without notice if there is any breach of this Agreement.
5. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices.
6. ACCEPTANCE
By registering on rustiquestore.com or by continuing to use the Site, the User confirms they have read, understood, and accepted all the terms and conditions outlined in this Agreement.
